Terms of Use – Profilr

1. Eligibility

You affirm you have legal capacity to agree, or have parental/guardian permission if required. The App is for a general audience and not directed to children; see our Privacy Policy for details.

2. Description of the Service

Profilr provides personality assessments (e.g., MBTI-like types), insights, and visual representations. The Service is currently free; paid features may be added later with updated terms. We may modify, suspend, or discontinue any part of the Service at any time.

3. Account Registration and Security

Creation: You may need an account using email/password, nickname, or social login (Google/Apple). Provide accurate, current information.

Responsibility: You are responsible for safeguarding credentials and all activity under your account. Notify us at app.profilr@gmail.com if you suspect compromise. We may suspend/terminate for unauthorized use or violations.

4. Personal Data and Privacy

Your use is governed by our Privacy Policy. If these Terms conflict with the Privacy Policy on data handling, the Privacy Policy controls for data matters.

5. License and Permitted Use

We grant a limited, non-exclusive, non-transferable, revocable license to download/install the App and use it for personal, non-commercial purposes. You must not copy, modify, reverse engineer, distribute, or misuse the Service, nor attempt unauthorized access or use automated means without permission.

6. User Content

Definition: Includes your personality test responses, generated profiles, and any content you submit/generate.

Ownership: You retain rights to your User Content, but grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use/process/store/display it to operate/improve the Service and to create aggregated/anonymized data. Subject to our Privacy Policy.

Responsibility: You are responsible for ensuring your content is lawful and non-infringing. We may remove content that violates these Terms.

7. Personality Assessments – No Professional Advice

Assessments and insights are informational/entertainment only. No medical, psychological, legal, financial, or professional advice is provided. Decisions based on results are at your own risk; consult qualified professionals for serious concerns.

8. Third-Party Services and Links

The Service may link to or share content via third-party platforms (e.g., Linktree, social). We are not responsible for third-party content or policies; use them at your own risk.

9. Intellectual Property

The Service (excluding User Content) including UI, visuals, code, and marks is owned/licensed by Jamil Orujlu. Do not remove notices or use the name “Profilr” or our marks without prior written consent.

10. Changes to the Service and Terms

We may add/modify/remove features or suspend/discontinue the Service. We may update these Terms and will update the “Last updated” date (and provide notice where required). Continued use means acceptance; stop using if you disagree.

11. Suspension and Termination

We may suspend/terminate access for violations, suspected fraud/abuse, or discontinuation. On termination, your right to use ceases and data may be deleted per the Privacy Policy. You may stop using anytime and request account/data deletion.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available.” We disclaim all warranties (merchantability, fitness, non-infringement, etc.). We do not guarantee uninterrupted or error-free Service or accuracy of results. Use at your own risk.

13. Limitation of Liability

To the maximum extent permitted, Jamil Orujlu and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, loss of profits/revenues/data/goodwill, or unauthorized access. Total liability is limited to amounts paid (if any) in the 12 months before the claim, or zero if none. Some jurisdictions may not allow certain limitations.

14. Indemnification

You agree to indemnify and hold harmless Jamil Orujlu and affiliates from claims arising from your use of the Service, violations of these Terms, rights of others, or User Content. We may assume defense and you will cooperate.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Azerbaijan. Disputes are subject to the exclusive jurisdiction of courts in Azerbaijan, unless law requires otherwise. You agree to personal jurisdiction and waive objections to venue.

16. Severability

If any provision is invalid/unenforceable, it will be enforced to the maximum extent allowed, and the remainder stays in effect.

17. No Waiver

Failure to enforce any right or provision is not a waiver. Any waiver must be in writing and signed.

18. Entire Agreement

These Terms and the Privacy Policy are the entire agreement regarding the Service and supersede prior agreements.
